L-1 Intracompany Transferee Visa


Overview

The L-1 Intracompany Transferee Visa is for employees of multinational companies who are being transferred to a U.S. office, subsidiary, or affiliate. It allows managers, executives, and specialized knowledge employees to work in the U.S. for a temporary period.

Eligibility Criteria

To qualify for the L-1 visa, the applicant must:

  • Have been employed by the overseas company for at least one continuous year within the preceding three years.
  • Be seeking to enter the U.S. to provide services in a managerial, executive, or specialized knowledge capacity.

Benefits

  • Allows for temporary work authorization in the U.S. for up to seven years for managers and executives, and up to five years for specialized knowledge employees.
  • Spouses and unmarried children under 21 can accompany the L-1 visa holder on L-2 visas and may apply for work authorization.

How to Apply

  1. The U.S. employer must file Form I-129, Petition for Nonimmigrant Worker, with the USCIS.
  2. Once the petition is approved, the applicant can apply for a visa at a U.S. embassy or consulate.


L-2 Dependent Visa


Overview

The L-2 Dependent Visa is for the spouses and unmarried children under 21 of L-1 visa holders. It allows them to accompany the L-1 visa holder to the U.S. and may provide them with the opportunity to work in the U.S.

Eligibility Criteria

To qualify for the L-2 visa, the applicant must:

  • Be the spouse or unmarried child under 21 of an L-1 visa holder.
  • Intend to accompany the L-1 visa holder to the U.S. for the duration of their stay.

Benefits

  • Allows for temporary residence in the U.S. for the duration of the L-1 visa holder's authorized stay.
  • Spouses may apply for work authorization in the U.S.

How to Apply

  1. The L-1 visa holder must file Form I-129, Petition for Nonimmigrant Worker, on behalf of their dependents.
  2. Once the petition is approved, the dependents can apply for a visa at a U.S. embassy or consulate.
