P-1B Artist/Entertainer Visa


Overview

The P-1B Artist/Entertainer Visa is for members of internationally recognized entertainment groups who are coming to the United States to perform as a group or individually. It is a non-immigrant visa, meaning it is temporary and does not lead to permanent residency.


Eligibility Criteria

To qualify for the P-1B visa, the artist/entertainer must:

  • Be a member of an entertainment group that has been internationally recognized for a sustained and substantial period of time.
  • Be coming to the U.S. to perform as part of that group.


Benefits

  • Allows for temporary stay in the U.S. for performances or events.
  • Spouses and unmarried children under 21 can accompany the P-1B visa holder on P-4 visas.


How to Apply

  1. The U.S. employer or sponsoring organization must file Form I-129, Petition for Nonimmigrant Worker, with the USCIS.
  2. Once the petition is approved, the artist/entertainer can apply for a visa at a U.S. embassy or consulate.


Duration of Stay

  • Initially granted for the duration of the event or performance, up to 1 year, with extensions available.


O-1B Extraordinary Ability Visa


Overview

The O-1B Extraordinary Ability Visa is for individuals with extraordinary ability or achievement in the arts, including actors. It is designed for those who have risen to the top of their field and wish to work in the U.S. temporarily.


Eligibility Criteria

To qualify for the O-1B visa, the actor must:

  • Demonstrate extraordinary ability or achievement in their field through sustained national or international acclaim.
  • Have a job offer from a U.S. employer for work in their field of extraordinary ability.


Benefits

  • Allows for temporary stay in the U.S. to work in the field of extraordinary ability.
  • Spouses and unmarried children under 21 can accompany the O-1B visa holder on O-3 visas.


How to Apply

  1. The U.S. employer must file Form I-129, Petition for Nonimmigrant Worker, with the USCIS.
  2. Once the petition is approved, the actor can apply for a visa at a U.S. embassy or consulate.


Duration of Stay

  • Initially granted for up to 3 years, with extensions available in 1-year increments.
